Fla. Jury Awards Family of Cancer Patient $25.8M in Wrongful Death Lawsuit Against Walgreens

BARTOW, Fla. (AP) -- A jury awarded $25.8 million Friday to the family of a cancer patient who was given a wrong prescription, had a stroke and died several years later, lawyers said.

Beth Hippely was prescribed Warfarin, a blood thinner, in 2002 to treat breast cancer. The prescription filled at a Walgreens pharmacy was 10 times what her doctor prescribed, court documents said.

The Polk County Circuit Court jury found the prescription error caused a cerebral hemorrhage resulting in permanent bodily injury, disability and physical pain. The mother of three died in January at the age of 46.

A 19-year-old pharmacy technician, with little training, misfiled the prescription, according to court documents.

The lawsuit was filed in 2003 by Hippely, her husband Deane Hippely and their children against the Deerfield, Ill.-based Walgreen Co. for negligent breach of duty and wrongful death.

"Beth Hippely died unnecessarily because this tenfold overdose with Warfarin by the pharmacy she trusted caused her cancer to come back with a vengeance and it interrupted all of her cancer treatments," her lawyer Chris Searcy said. "They have been seeking justice for almost five years and this was a case that screamed out for justice."

A statement released by the company expressed sympathy for the Hippely family.

"We're truly sorry for what the Hippely family has been through, and we've personally apologized to them," Walgreens spokeswoman Carol Hively said in a statement. "We have been, and continue to be, the leader in pharmacy safety initiatives. We had hoped the verdict would have been fair and reasonable."

Hively said the company had not decided if it would appeal the decision.

That is how Charlie Munger welcomed shareholders to the 2007 Wesco (AMEX:
WSC - News) Annual Meeting. The cult, of course, is the loyal throng of value investors that invade both Omaha, Neb., and Pasadena, Calif., each spring to learn at the feet at Warren Buffett and Charlie Munger, and as Munger noted "to leave a little wiser than they came."

This year the meeting was held inside a massive tent at the Pasadena Civic Center. Munger called the tent, which was an impressively engineered structure, a "tribute to the civilization."

¡ÊËÜǯÅÙ¤ÎÁí²ñ¤Ï¥Ñ¥µ¥Ç¥£¥Ê¡¦¥·¥Ó¥Ã¥¯¡¦¥»¥ó¥¿¡¼¤Î¹Âç¤Ê¥Æ¥ó¥È¤ÎÃæ¤Ç³«¤«¤ì¤Þ¤·¤¿¡£¥Þ¥ó¥¬¡¼»á¤Î¸À¤¦¤Ë¤Ï¤½¤Î°õ¾ÝŪ¤Ê¹©³ØŪ¹½Â¤¥Æ¥ó¥È¤ò”ʸÌÀ¤Ø¤Î»¿¼”¤È¾Þ»¿¤·¤Æ¤¤¤Þ¤¹¡£

The body of Munger's talk this year focused on the reasons why Buffett and Berkshire Hathaway (brk.b.B) became such a "lollapalooza" success. Munger gave several factors that, working in concert, led to one of the most spectacular investment and business records in the history of capitalism. Those factors are:

¡Êº£Ç¯¤Î¥Þ¥ó¥¬¡¼»á¤ÎÏäÎÃæ¿È¤Ï¤Ê¤¼¥Ð¥Õ¥§¥Ã¥È»á¤È¥Ð¡¼¥¯¥·¥ã¡¼¼Ò¤¬”¶Ã°ÛŪ¤Ê”À®¸ù¤È¤Ê¤Ã¤¿¤«¤Ë¾ÇÅÀ¤òÅö¤Æ¤¿¤Î¤Ç¤¢¤Ã¤¿¡£¥Þ¥ó¥¬¡¼»á¤Ï¡¢Æó¿Í¤¬¶¦¤Ë»Å»ö¤ò¤·¤¿Ãæ¤Ç¡¢»ñËܼçµÁ¤ÎÎò»Ë¤Ë±÷¤¤¤ÆºÇ¤â¶Ã°ÛŪÅê»ñ³î¤ÄµÏ¿Åª¤Ê¥Ó¥¸¥Í¥¹¤ËƳ¤«¤ì¤¿´ö¤Ä¤«¤ÎÍ×ÁǤˤĤ¤¤Æ¸ì¤Ã¤¿¡£¤½¤ì¤é¤Ï¡§

Mental Aptitude. Warren Buffett is obviously a very smart man, but Munger stated he probably overachieved given his innate mental ability. For example, Buffett could not "beat all comers playing chess blindfolded" like U.S. chess champion Patrick Wolff. (Wolff beats multiple opponents simultaneously while blindfolded at Berkshire Hathaway annual meetings.) Using the dry humor of a ridiculous understatement, Munger called Wolff's skill "interesting."

¡Ê¿´ÍýŪÁǼÁ¡£¥Ð¥Õ¥§¥È»á¤Ï¤â¤Á¤í¤ó¤È¤Æ¤â¸¤¤¿Í¤À¤¬¡¢¥Þ¥ó¥¬¡¼»á¤¬¸À¤¦¤Ë¤Ï¡¢Èà¤Î¿´ÍýŪǽÎϤò¹Í¤¨¤ë¤È¡¢Â¿Ê¬¤è¤¤·ë²Ì¤ò½Ð¤·¤¹¤®¤¿¤È¤Î¤³¤È¡£Î㤨¤Ð¡¢Èà¤ÏÊƹñ¥Á¥§¥¹¡¦¥Á¥ã¥ó¥Ô¥ª¥ó¤Î¥Ñ¥È¥ê¥Ã¥¯¡¦¥¦¥©¥ë¥Õ»á¤Î¤è¤¦¤Ë¡¢Ìܱ£¤·¤ò¤·¤Æ¤Ç¤âÁ´¤Æ¤Î¥Á¥§¥¹Ä©Àï¼Ô¤Ë¾¡¤Æ¤ë¤ï¤±¤Ç¤Ï¤Ê¤¤¡Ê¥Ñ¥È¥ê¥Ã¥¯¡¦¥¦¥©¥ë¥Õ»á¤Ï¥Ð¡¼¥¯¥·¥ã¡¼¼Ò¤Î³ô¼°Áí²ñ¤Ç¼«Ê¬¤ËÌܱ£¤·¤ò¤·¤Æ¤Ç¤âÊ£¿ô¤ÎƱ»þ¤ËÂз褹¤ëÄ©Àï¼Ô¤Ë¾¡¤Æ¤ë¡Ë¡££ø£ø£ø£ø£ø¡¢¥Þ¥ó¥¬¡¼»á¤ÏÈó¾ï¤Ë¹µ¤¨¤á³î¤Ä¥æ¡¼¥â¥¢¤Ç¥¦¥©¥ë¥Õ»á¤Î¥¹¥¥ë¤ò”¤ª¤â¤·¤í¤¤”¤È½Ò¤Ù¤Æ¤¤¤ë¡£

Intense Interest. Munger noted that Buffett was intensely interested in business and investing from a very young age. "There is no substitute for a very intense interest."

Early Start. Another factor in the success of Berkshire Hathaway was that Buffett got an early start and was able to use his skills to compound capital over many decades.

¡ÊÁᤤ»þ´ü¤Î¥¹¥¿¡¼¥È¡£¥Ð¡¼¥¯¥·¥ã¡¼¼Ò¤ÎÀ®¸ù¤Î¤â¤¦°ì¤Ä¤ÎÍ×ÁǤϥХե§¥Ã¥È»á¤¬Á᤯»Ï¤á¡¢²¿½½Ç¯¤â¤Î´Ö¤ËÊ£ÍøŪ¤Ë»ñ¶â¤òÁý¤ä¤¹µ»½Ñ¤ò»ÈÍѤ¹¤ë¤³¤È¤¬½ÐÍ褿¡£

Constant Learning. Munger stated that Buffett is one of the best "learning machines." The key to success is to continue learning throughout your life with a voracious appetite. Munger later circled back to this topic when he said the best way to gain wisdom was by "sitting on your (behind) and reading all day."

Concentration. Another factor in Berkshire's success was that the work was heavily concentrated in Buffett's mind. "It's hard to think of committees that have been successful." Munger used the analogy of John Wooden's player rotation strategy. The great UCLA basketball coach would only play seven out of his 12 players, so as to concentrate the experience into his seven best players. Similarly, most of Berkshire's work was concentrated in its best mind, Buffett's.

One questioner asked about a closely held belief that Munger had recently overturned. After some thinking, Munger responded that Berkshire's recent purchase of railroad stocks marked a 180 degree change in thinking about the industry. According to Munger, railroads now have a huge competitive advantage over trucking because of innovations such as double-stacked cars and computer modeling of routes. Munger said he and Buffett were too late in recognizing the changes and could have made much more money. Apparently, Bill Gates figured out it out two years ago and made "multiples of his money" with railroads.
